These Terms & Conditions constitute a legally binding agreement between you (the “Customer” or “Passenger”) and Lone Star Executive Limousine (“the Company”). By utilizing the services, website (lonestarlimo.com), or booking a reservation with Lone Star Executive Limousine, you acknowledge that you have read, understood, and agree to be bound by the following policies, terms, and conditions.

1. Reservations, Billing, and Payments

  • Deposits: All reservations require a one-third (33%) non-refundable deposit to be taken at the time the reservation is made. At this time, both the Customer and Lone Star Executive Limousine enter into a binding contract.

  • Corporate Accounts: Past due corporate accounts are subject to a late fee of 1.5% per month (18% annually) and any applicable attorneys’ fees, collection fees, and court costs. Lone Star Executive Limousine reserves the right to convert corporate billing accounts to “credit card only” status at its discretion.

  • Flat Rates: Standard point-to-point rates provide flat-rate pricing for travel to and from most major airports, cruise terminals, and cities. Travel between locations where a point-to-point rate is not available will be billed at the current applicable hourly rate. Customers are billed from the time the vehicle leaves our facility until it returns, with a standard four (4) hour minimum service applying.

  • Rounding: Service times resulting in fractions of an hour will be rounded to the next thirty (30) minute interval.

  • Incidental Charges: Parking, tolls, and incidental charges are not included in quotes or confirmations. These charges will be billed as incurred at the conclusion of your trip.

2. Wait Time, Stops, and Detours

  • Commercial Airport Wait Time: Thirty (30) minutes of free waiting time is provided to all domestic flight customers from the official posted arrival time. One (1) hour of free waiting time is given on all international flights. Additional waiting time will be calculated in fifteen (15) minute increments and billed at the vehicle’s regular hourly rate.

  • Standard Wait Time: For non-airport reservations, ten (10) minutes of free wait time is given. Any additional wait time will be charged in thirty (30) minute increments at the vehicle’s regular hourly rate.

  • Private Flights & Trains: Lone Star Executive Limousine does not monitor private flights or train/locomotive schedules. Wait time will be charged as incurred for any passenger arriving via private plane or train delayed by more than ten (10) minutes.

  • Extra Stops: Passenger-requested stops en route (which do not result in a detour) during a point-to-point reservation will be charged $20.00 per stop for a maximum of ten (10) minutes. Charges revert to the hourly rate after ten (10) minutes. Stops off route (detours) will be billed directly at the vehicle’s current hourly rate.

  • City-to-City: Roundtrips include up to four (4) hours of wait time and must be completed within the same calendar day. Wait time over four (4) hours will be charged at the vehicle’s current hourly rate.

3. Cancellations & No-Show Policy

  • Standard Cancellation: Cancellation of reservations within twenty-four (24) hours of a scheduled pick-up will result in a full charge equal to the base fare price of the trip, plus a 15% service fee.

  • Limousine/Specialty Vehicle Cancellation: Cancellation of specialized limousine service with less than seventy-two (72) hours’ notice will be charged the vehicle’s hourly minimum for the minimum hours required.

  • No-Show Fees: A ‘no-show’ fee equal to the base fare price of the trip, plus applicable wait time fees, plus a 15% service fee will be charged when a passenger fails to arrive at the designated location.

  • If you are unable to locate your vehicle or driver, you must call (832) 585-7338 immediately to avoid being charged a no-show fee.

4. Vehicle Damage, Cleanup, and Conduct

The Customer assumes full financial liability for any damage to the vehicle caused during the duration of the rental by them or any members of their party.

  • Cleaning Fees: For excessive cleanup resulting from spills, food, mud, etc., we may assess a cleanup charge of $100.00 at our discretion.

  • Bodily Fluids: We will assess a strict charge of $350.00 per incident of vomiting or bodily fluid cleanup in any vehicle. This charge may be higher depending on the actual costs of professional cleaning and sterilization.

  • Smoking: Lone Star Executive Limousine maintains a strict non-smoking policy. A $350.00 cleaning charge will be applied for smoking (including vaping) in any vehicle.

  • Damage Fees: Other damage charges include, but are not limited to: $15.00 per broken champagne/rock glass; $1,000.00 per seat tear, hole, or puncture. Broken, damaged, or missing equipment will be billed at the exact cost to repair or replace the item.

  • Alcohol Policy (TABC Compliance): In strict compliance with Texas Alcoholic Beverage Code (TABC) § 106.04, the consumption of alcohol by any passenger under twenty-one (21) years of age is strictly prohibited. The Company reserves the right to terminate service immediately, without refund, if underage drinking is discovered.

5. Limitation of Liability & Force Majeure

  • Delays & Traffic: While we allocate reasonable time to allow for traffic, Lone Star Executive Limousine is not responsible for delays caused by traffic, accidents, weather, road conditions, or acts of nature. In the event of an unavoidable delay on our end, compensation will be limited to additional service time at the end of the charter, not to exceed the time lost.

  • Breakdowns: Due to the structural engineering of our vehicles, should mechanical trouble occur, the Customer is subject to downtime only and cannot recoup or file suit for any further retribution.

  • Lost Items: Lone Star Executive Limousine assumes no responsibility for lost, damaged, or stolen baggage, personal belongings, or any items left in our vehicles.

  • Vehicle Requests: Specific vehicle models and color requests are subject to availability and are not guaranteed.

6. Website Terms of Use

  • The materials on lonestarlimo.com are provided ‘as is’ without any representation or warranty, expressed or implied.

  • Lone Star Executive Limousine reserves the right, at its sole discretion, to change, modify, add, or remove portions of these terms at any time. Continued use of the site or our services following posted changes constitutes your acceptance of those changes.

  • We are not liable for direct, indirect, special, or consequential damages related to the use of our website or linked third-party platforms.

7. Governing Law and Dispute Resolution (State of Texas)

Choice of Law: This Agreement and all services provided by Lone Star Executive Limousine shall be governed by, construed, and enforced in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Venue and Jurisdiction: Any legal suit, action, or proceeding arising out of or relating to this Agreement or the services provided shall be instituted exclusively in the state or federal courts located in Montgomery County, Texas. The Customer irrevocably submits to the exclusive jurisdiction of such courts in any such suit, action, or proceeding.

8. Severability

If any provision of these Terms & Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction in the State of Texas, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of this Agreement shall remain in full force and effect.
